Please take notice that the City of Utica Zoning Board of Appeals will hold a Public Hearing on Tuesday, SEPTEMBER 19, 2023 at 5:00 pm in the Common Council Chambers of Utica City Hall.

 

According to Section 2-29-77 of the City of Utica Zoning Ordinance, with respect to an application for a variance, the clerk of the board shall send written notice to all owners of property within 200 feet of the exterior boundaries of the subject property.

This letter shall serve as written notice of stated ordinance.

Applicant:  Ibrahim Mohamed

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to legitimize the construction of an addition at the above referenced property.

 

The applicant has partially constructed an addition to the rear of his home.  The addition extends approximately 7’ from the rear property line.  The applicant has stated that they will be utilizing the addition for more living space for his family.

 

In accordance with Section 2-29-126 of the Zoning Ordinance of the City of Utica, 10’ is the minimum required rear yard setback for any structure in a residential mixed zoning district.  The applicant will be required to receive an area variance in order to reduce the setback to seven feet.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to install fencing at the above referenced property.

 

The applicant has installed six (6) sections of a black aluminum fence with wood borders and wood posts.  The fence will run along the inside edge of the public sidewalk.  The applicant has expressed concerns that he has had homeless people sleeping on the lot next door to the apartment building and he is looking to secure the area.  Mr. Pastore has stated that the lot will still be visible since the fence is an open style fence. 

 

The applicant has stated that there has been a lot of pedestrian traffic on this lot with litter and debris being left behind for him to clean up. 

 

The application was reviewed and approved by the City of Utica’s Scenic and Historic Preservation Commission contingent upon the applicant painting the wood portion of the fence black to match the aluminum. 

 

In accordance with Section 2-29-185 of the Zoning Ordinance of the City of Utica, fences are not permitted within the Central Business District, therefore, the applicant will be required to receive an area variance in order to construct a fence at this location.
