Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order legitimize the construction of a fence at the above referenced property.

 

The applicant has installed a 6’ high wood stockade fence at the above referenced property.  The property is located on a corner lot.  In accordance with Section 2-29-126(e) of the Zoning Ordinance of the City of Utica, a corner lot has two front yard setbacks since the property fronts on two streets.   

 

In accordance with Section 2-29-585 of the Zoning Ordinance of the City of Utica, all solid fences measuring more than three feet high are prohibited in the front yard.  The applicant will be required to receive an area variance for the installation of the 6’ solid fence.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to construct a garage at the above referenced property.

 

The applicant is proposing to construct a 24’ x 30’ (720 sf) detached garage in the rear of the property.  The proposed garage will face Sunnybrook Lane.  The garage will be approximately 1.5’ from the side property line on Sunnybrook Lane.  In accordance with Section 2-29-126(d) of the Zoning Ordinance of the City of Utica, the minimum setback for an accessory structure is 5’ from the rear and side property line.  The applicant will be required to receive an area variance for the reduction in the side yard setback. 

 

In accordance with Section 2-29-126(d) of the Zoning Ordinance of the City of Utica, the parking setback shall be greater than the primary façade.  The applicant will be required to receive an area variance for the placement of the garage beyond the front line of the primary structure.  The garage will be required to be set back at least 12.5’ from the edge of the road to allow for the area of the City right-of-way.  The applicant will be required to receive a curb cut permit from the City of Utica Engineering Department for the access for the driveway.

 

The garage will be wood framed with an asphalt shingled roof.  The foundation will be concrete.  It will be a classic design.  The exterior of the garage will be white with a black roof to match the existing house.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to erect a 6’ high solid wood fence on the Grove Place side of the property.   The chain link fence on Grove Place will be replaced with a 6’ solid wood fence 85’ in length.  The applicant currently has a 4’ to 5’ chain link fence along the perimeter of the property which will remain in place except for this section on Grove Place.

 

In accordance with Section 2-29-185 of the Zoning Ordinance of the City of Utica, the applicant will be required to receive an area variance in order to install a 6’ solid fence.
