Please take notice that the City of Utica Zoning Board of Appeals will hold a Public Hearing on Tuesday, JUNE 15, 2021 at 5:00 pm in the Common Council Chambers of Utica City Hall.

 

According to Section 2-29-108(3)(b) of the City of Utica Zoning Ordinance, with respect to an application for a variance, the clerk of the board shall send written notice to all owners of property within 200 feet of the exterior boundaries of the subject property.

This letter shall serve as written notice of stated ordinance.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high solid wood fence on a corner property. This is a vacant lot adjacent to the home.  The fence will be approximately 2’ from the inside edge of the sidewalk.  It will extend on Kossuth Ave from the driveway toward Bleecker Street and along the Bleecker Street frontage.

 

In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential Mixed zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

 

In accordance with the Zoning Ordinance of the City of Utica, no obstruction to vision, other than an existing building, post, column or tree, exceeding 24 inches in height above the established grade of the street at the property line shall be erected or maintained on any lot within the triangle formed by the street lot lines of such lot and a line drawn between the points along such street lot lines 30 feet distant from their points of intersection.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high solid fence on a corner property.  The applicant is seeking a variance in order to enclose a side/front yard at his residence.  The fence will be approximately 1’ from the inside edge of each sidewalk on Harriet/Baker Avenue.  It will extend from the corner edge of the house out toward Harriet Street run along the sidewalk and down Baker Avenue to connect with an existing chain link fence in the rear of the property.  

 

In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential Mixed zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to install signage at the above referenced property.

 

The applicant has constructed a 49,900 +/- square foot commercial building and is proposing to install signage for the various tenants of the building.

 

The applicant is proposing to install a multi-tenant sign which will be two sided 24’(w) x 23.8’(h).  In accordance with the Zoning Ordinance of the City of Utica, the maximum area permitted for a multi-tenant sign in an Urban Mixed Use zoning district is 80sf and the maximum height permitted is 20’.  The applicant will be required to receive area variances for the area and height of the sign. The sign will have a 21’(w) x 7’(h) double sided panel which will read LIVE IT DOWNTOWN.  The sign will have space for eight (8) tenant signs below. 

 

The applicant additionally is proposing to install eight (8) 7’(w) x 1.25’(h) individual tenant signs above the businesses along with a 16’(w) x 7.66’(h) (The Fitness Mill) main sign on the face of the building which will be internally illuminated.  The total square footage for all of these wall signs will equal 192.56 sf.  In accordance with the Zoning Ordinance of the City of Utica the maximum area for wall signs permitted in an Urban Mixed Use zoning district is 60 sf, therefore, the applicant is seeking an area variance in order to increase the size of the proposed signage.
