According to Section 2-29-108 of the City of Utica Zoning Ordinance, with respect to an application for a variance or special use permit, the clerk of the board shall send written notice to all owners of property within 200 feet of the exterior boundaries of the subject property.

 

This letter shall serve as written notice of stated ordinance.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to construct a garage at the above referenced property.

 

The applicant is proposing to construct a 24’ x 28’ (672 sf) two stall garage in the rear of the property.  The garage will be 17’ high.  In accordance with the Zoning Ordinance for the City of Utica, the maximum height of an accessory structure is a height less than the height of the primary building.  The height of the existing house is 16’, therefore, the applicant will be required to receive an area variance for the additional height requested. 

 

The applicant is seeking an area variance in order to locate the proposed garage on the side property line.  In accordance with the Zoning Ordinance for the City of Utica, the minimum side yard setback for an accessory structure is 5’. 

 

The applicant is proposing to install an additional driveway that will access the proposed garage.  A curb cut permit will be required by the Engineering Department.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to install a swimming pool at the above referenced property.

 

The applicant is proposing to install an 18’ above ground pool in the rear yard of the property at this location.  In accordance with Section 2-29-584 of the Zoning Ordinance for the City of Utica, the minimum side and rear yard setback for a swimming pool is 5’.  The applicant is proposing to have a 2’ side yard setback, therefore, will require an area variance for the reduction in the side yard setback.  The rear yard setback will be 5’ as required.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high white vinyl fence along the Hollingsworth side of the property and connect to the fence to the existing fence in the rear of the property.  This property is situated on a corner lot, therefore is considered to have two front yards. 

 

In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential Mixed zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

 

The City right-of-way ends 17’ from the edge of the pavement.  In accordance with the Zoning Ordinance for the City of Utica, no structure or fence shall be erected within the City right-of-way.  Therefore, if approved, the fence will be required to be installed at least 17’ back from the edge of the pavement of the road.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to extend an existing garage at the above referenced property.

 

The applicant has constructed a 17’ x 11’ addition to their existing 20’ x 20.5’ garage in the rear of the property.  The garage is approximately 4’ from the rear property line and approximately 1.5’ from the side property line. 

 

In accordance with the Zoning Ordinance for the City of Utica, the minimum rear and side yard setback for an accessory structure is 5’.  The applicant is seeking an area variance for the reduction in the rear and side yard setbacks.
