According to Section 2-29-108(3)(b) of the City of Utica Zoning Ordinance, with respect to an application for a variance or special use permit, the clerk of the board shall send written notice to all owners of property within 200 feet of the exterior boundaries of the subject property.

 

This letter shall serve as written notice of stated ordinance.

The applicant has installed a 6’ wood stockade fence in the front yard approximately 2’ from the edge of the sidewalk and runs along the side property line to an existing fence in the rear of the property. In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential Two-Family zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

The applicant currently has a 6’ high white vinyl fence along the side of the property.  They are proposing to continue the existing fence along the property line to extend out toward the sidewalk.  This will only be an addition of three (3) new panels.  The fence will not run along the sidewalk.

The applicant has previously installed a 6’ high white vinyl fence along the side and rear property line of the parcel.  The applicant is proposing to extend the 6’ high fence along the side property line in the front yard toward the sidewalk.  The fence will extend along the side of the driveway to create a barrier from the vacant lot on the corner adjacent to this property.

The applicant has installed a 6’ high wood stockade style fence along the front sidewalk and down the side property line to provide protected space for his children and dog.  The applicant has stated that since the house is positioned in the rear of the property, the front yard is primarily the only yard available for his children and dog. 

 

In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential Two-Family zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

Pursuant to Section 2-29-67(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to construct a shed at the above referenced property.

 

The applicant is proposing to construct a 10’ x 12’ (120 sf) shed in the rear of the property.  The parcel is located on a corner lot, however, the proposed shed will be positioned in the rear of the lot.  In accordance with Section 2-29-492 of the Zoning Ordinance of the City of Utica, the maximum size for an accessory storage structure in a residential zoning district is 100 sf.  The applicant will be required to receive an area variance to increase the size of the proposed storage unit to 120 sf.  The applicant has recently purchased the home and does not have the amount of space as the previous home, therefore requires additional storage space.  The shed will match the existing home.

Pursuant to Section 2-29-67(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to legitimize the construction of a fence at the above referenced property.

 

The applicant has constructed a 6’ high wood stockade fence on the interior line of the sidewalk along Pellettieri Avenue and down the Catherine Street side of the property.   In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential Multi-Family zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

In accordance with Section 2-29-581 of the Zoning Ordinance of the City of Utica, visibility requirements for corner lots: no obstruction to vision exceeding 30 inches in height above the established grade of the street at the property line shall be erected or maintained on any lot within the triangle formed by the street lot lines of such lot and a line drawn between the points along such street lot lines 30 feet distant from their points of intersection.  This will be a requirement if the fence is approved for the area variance.
