Please take notice that the City of Utica Zoning Board of Appeals will hold a Public Hearing on Tuesday, JULY 20, 2021 at 5:00 pm in the Common Council Chambers of Utica City Hall.

 

According to Section 2-29-108(3)(b) of the City of Utica Zoning Ordinance, with respect to an application for a variance, the clerk of the board shall send written notice to all owners of property within 200 feet of the exterior boundaries of the subject property.

 

This letter shall serve as written notice of stated ordinance.

Pursuant to Section 2-29-67(4)(b) of the Zoning Ordinance of the City of Utica, the applicant is seeking a use variance in order to expand an existing auto repair center at the above referenced property.

 

The applicant is proposing to construct a 22’ x 29’ addition to the existing garage on the Blandina Street side of the property.  Due to the pandemic, the applicant has stated that his business has decreased significantly since the inventory of used cars has been reduced by the closure of many auction houses.  This hardship has led to the need to expand the repair side of the business in order to remain in business.

 

In accordance with Section 2-29-82 of the Zoning Ordinance of the City of Utica, a nonconforming use shall not be expanded beyond the area of the existing structure in which the use is located, unless granted a use variance from the Zoning Board of Appeals.  In accordance with the Zoning Ordinance of the City of Utica, the min/max setback allowed in a Neighborhood Mixed Use zoning district is the average of the street.  The newly proposed addition will be in line with the existing houses on the block.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high solid white vinyl fence on the perimeter of a corner property.  The applicant is seeking a variance in order to enclose a side/front yard at this residence.  The fence will be approximately 1’ from the inside edge of each sidewalk on Grandview/Wesley Avenue.  It will extend from the edge of the driveway on Grandview out toward the corner and run along the entire property on the Wesley Avenue side of the home.

 

In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.

 

In accordance with the Zoning Ordinance of the City of Utica, no obstruction to vision, other than an existing building, post, column or tree, exceeding 24 inches in height above the established grade of the street at the property line shall be erected or maintained on any lot within the triangle formed by the street lot lines of such lot and a line drawn between the points along such street lot lines 30 feet distant from their points of intersection.

Pursuant to Section 2-29-67(4)(a) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high solid white vinyl fence in the front yard of the property.   The fence will extend off the front edge of the home along the Woodbury Drive side of the property toward Keyes Road.  The fence will extend back along the Keyes Road side of the property to the line of the existing chain link fence.  The fence will be approximately 11’ from the property line on Keyes Road.  The existing chain link fence in the rear and side of the home will be replaced with vinyl fencing. 

 

In accordance with the Zoning Ordinance of the City of Utica, a maximum height of 3’ solid style fence is allowed in the front yard in a Residential zoning district.   The applicant will be required to receive an area variance for the proposed height and location of the fence.
